This website is operated by EMPIRE AIRSOFT EU SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ. Throughout the site, the terms “we”, “us” and “our” refer to EMPIRE AIRSOFT EU SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ.
Our store is hosted on Lightspeed. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
§1 Preliminary Provisions
- The Empire Airsoft EU online store, available at www.empireairsoft.eu, is operated by EMPIRE AIRSOFT EU SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, located at ul. Szydło 42, 32-085 Modlnica, NIP 5130292475, REGON 527947355, KRS 0001091209.
- These terms and conditions are directed at consumers and define the rules and procedure for entering into a distance sales agreement through the Store.
§2 Definitions
- Consumer – a natural person entering into an agreement with the Seller through the Store, which is not directly related to their business or professional activity.
- Seller – EMPIRE AIRSOFT EU SP. Z O.O.
- Client – any entity making purchases through the Store.
- Store – the online store operated by the Seller at www.empireairsoft.eu.
- Distance Contract – an agreement concluded with the Client within a structured system of distance contracts (within the Store), without the simultaneous physical presence of the parties, using exclusively one or more means of distance communication up to the conclusion of the contract.
- Terms and Conditions – these terms and conditions of the Store.
- Order – a declaration of will by the Client, submitted via the Order Form and directly aimed at concluding a Sales Agreement for the Product or Products with the Seller.
- Product – a movable item/service available in the Store that is the subject of the Sales Agreement between the Client and the Seller.

Clients can communicate with the Seller using the addresses and phone numbers provided in this paragraph. Physical visits to these addresses are prohibited; they are for correspondence and returns only.
§4 Technical Requirements
To use the Store, including browsing the Store's assortment and placing orders for Products, the following are required:
- A terminal device with internet access and a web browser,
- An active email account,
- Enabled cookies.
§5 General Information
- The Seller, to the widest extent permitted by law, is not liable for disruptions, including interruptions, in the functioning of the Store caused by force majeure, unauthorized actions of third parties, or incompatibility of the online Store with the Client's technical infrastructure.
- Browsing the Store's assortment does not require setting up an Account. Placing orders by the Client for Products in the Store's assortment is only possible after setting up an Account in accordance with the terms of the regulations. Prices in the Store are given in euros and Polish zlotys and are gross prices (including VAT).
§6 Setting Up an Account in the Store
- To set up an Account in the Store, you need to fill out the Registration Form. It is necessary to provide an email address and password.
- Setting up an Account in the Store is free.
- Logging into the Account is done by providing the email address and password established in the Registration Form.
- The Client can delete their Account at any time, without giving a reason and without incurring any charges, by sending an appropriate request to the Seller, especially via email or in writing to one of the addresses provided in §3.
§7 Rules for Placing Orders
- To place an Order:
- Log in to the Store (optional);
- Select the Product that is the subject of the Order, and then click the "Add to cart" button;
- Log in, fill out the Order Form by entering the recipient's details and address for delivery of the Product, choose the type of shipment, enter invoice details if different from the recipient's details;
- Click the "Order and pay" button;
- Choose one of the available payment methods and, depending on the payment method, pay for the order within the specified period.
§8 Offered Delivery and Payment Methods
- The Client can use the following delivery or collection methods for the ordered Product:
- Courier shipment via DPD and Inpost, Inpost Parcel Lockers, DPD Pick-Up.
- The Client can use the following payment methods:
- Electronic payments,
- Payment cards:
- Visa,
- Visa Electron,
- Mastercard,
- MasterCard Electronic,
- Maestro,
- American Express,
- Discover Card,
- JCB,
- Diners Club,
- PayPal,
- PayPal Later.
- Detailed information on delivery methods and accepted payment methods can be found on the Store's website.
§9 Execution of the Sales Agreement
- The conclusion of the Sales Agreement between the Client and the Seller takes place after the Client submits an Order using the Order Form in the Online Store in accordance with §7 of the Regulations.
- After placing the Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for execution is sent by the Seller to the Client via email to the address provided during the Order submission.
- If the Client chooses:
- Electronic payments or payment by payment card, the Client is obliged to make the payment within 24 hours of concluding the Sales Agreement – otherwise, the order will be canceled;
- The Product will be sent by the Seller within the time specified in its description, in the manner chosen by the Client during the Order submission.
- In the case of orders for Products with different delivery times, the delivery time is the longest specified time.
- The start of the delivery period for the Product to the Client is counted as follows:
- If the Client chooses electronic payments or payment by payment card – from the date of crediting the Seller's bank account.
§10 Right to Withdraw from the Agreement
- The Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
- The period for withdrawal from the Sales Agreement starts from the delivery of the Product to the Consumer.
- The Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller.
- The statement of withdrawal from the Agreement may be sent by traditional mail or electronically.
- In the event of withdrawal from the Agreement, the Consumer will be refunded all payments made, including the costs of delivery of the item, except for additional costs resulting from the chosen method of delivery other than the cheapest standard delivery method offered by the Seller.
- The refund of payments will be made using the same methods of payment as used by the Consumer in the original transaction, unless the Consumer expressly agrees to a different solution.
§11 Complaints and Warranty
- The Sales Agreement covers new Products. The condition of each used Product is described in detail on the Store's website.
- The Seller is obliged to provide the Client with a product free from defects.
- In the event of a defect in the goods purchased from the Seller, the Client has the right to file a complaint based on the provisions of the Civil Code.
- Complaints should be submitted in writing or electronically to the addresses provided in these Terms and Conditions.
- The Seller will respond to the complaint immediately, no later than within 30 days.
§12 Personal Data
- The administrator of the personal data of Clients collected via the online Store is the Seller.
- Personal data of Clients is collected for the purpose of fulfilling the Sales Agreement, and if the Client agrees – also for marketing purposes.
- Recipients of the personal data of the Store's Clients may be carriers, intermediaries executing shipments, and entities handling payments in the online Store.
- The Client has the right to access their data and correct it.
- Providing personal data is voluntary, but failure to provide the necessary personal data results in the inability to conclude the Sales Agreement.
§13 Final Provisions
- The Seller reserves the right to make changes to the Terms and Conditions for important reasons, such as changes in law, changes in payment and delivery methods.
- Matters not covered by these Terms and Conditions are governed by Polish law.
- The Client has the right to use out-of-court complaint and redress procedures.
